Credit Account Terms and Conditions | NSP Cases

1. Credit Account Approval

Credit facilities are provided by NSP Cases at our discretion and are subject to approval following the completion of any credit application and/or credit assessment that we may require.

The granting of a credit account does not constitute an obligation to provide credit indefinitely. NSP Cases reserves the right to review, amend, suspend or withdraw credit facilities at any time where we consider it appropriate.

2. Agreed Payment Terms

All credit account invoices are payable within 30 days from the date of invoice (“30-day terms”).

Payment must be received in full by the due date stated on the invoice.

The customer is responsible for ensuring that payment is made within the agreed 30-day period, regardless of whether a payment reminder or statement has been issued.

3. Credit Limits

A credit limit may be assigned to each approved credit account at the discretion of NSP Cases.

Customers must not exceed their agreed credit limit without prior written approval from NSP Cases.

NSP Cases reserves the right to reduce or withdraw a customer's credit limit where payment performance, account activity, financial circumstances or other relevant factors give us reasonable cause to do so.

4. Invoicing and Disputed Invoices

Invoices will be issued in accordance with the goods and/or services supplied.

Any invoice query or dispute must be notified to NSP Cases promptly and, where possible, before the invoice becomes due for payment.

Where only part of an invoice is disputed, the undisputed portion remains payable in accordance with the agreed 30-day payment terms.

5. Overdue Accounts

An account will be considered overdue where payment has not been received in full by the applicable due date.

Where an account becomes overdue, NSP Cases reserves the right to:

  • suspend or restrict further credit;
  • place the account on hold;
  • require payment in advance for future orders;
  • reduce or withdraw the customer's credit limit;
  • require outstanding balances to be paid before further goods or services are supplied; and/or
  • take appropriate steps to recover the outstanding debt.

Any decision to suspend or withdraw credit facilities will not affect the customer's obligation to pay amounts already due.

6. Recovery of Outstanding Amounts

Where an account remains unpaid after the agreed payment date, NSP Cases reserves the right to recover any reasonable costs incurred in seeking payment, to the extent permitted by applicable law and the terms of the relevant contract.

This may include reasonable administrative, legal, debt recovery and other costs associated with recovering overdue amounts.

7. Suspension of Credit Facilities

If an account becomes overdue, NSP Cases may suspend the customer's credit facility without prior notice where reasonably necessary to protect our position.

During any period of suspension, further orders may be accepted only on a payment-in-advance, cleared-funds or other basis agreed by NSP Cases.

Restoration of credit facilities will be at the discretion of NSP Cases and may be subject to the account being brought fully up to date.

8. Changes in Customer Circumstances

The customer must notify NSP Cases promptly of any material change that may affect its ability to meet its payment obligations.

This includes, but is not limited to, changes in ownership, business structure, trading status, insolvency proceedings, administration, liquidation or other circumstances that may reasonably affect the customer's ability to pay its debts as they fall due.

9. Personal Guarantees and Additional Security

Where requested by NSP Cases, credit facilities may be subject to the provision of additional security, guarantees or other assurances acceptable to us.

Any such security or guarantee will be governed by the separate terms under which it is provided.

10. Payment Allocation

Where a customer has more than one outstanding invoice or account, NSP Cases reserves the right, to the extent permitted by law, to allocate payments received against outstanding amounts in the manner we consider appropriate.

11. Continued Acceptance of Orders

Acceptance of an order from a customer with an existing credit account does not constitute confirmation that the account remains within its approved credit limit or that previous invoices have been paid within the agreed terms.

NSP Cases reserves the right to decline, delay or place an order on hold where the customer's account exceeds its credit limit or contains overdue amounts.

12. Right to Review Credit Facilities

Credit facilities may be reviewed periodically or whenever NSP Cases considers it necessary.

Following a review, NSP Cases may maintain, increase, reduce, suspend or withdraw the customer's credit facility.

13. No Waiver

Any failure or delay by NSP Cases in enforcing the agreed payment terms or exercising any of its rights in relation to an overdue account will not constitute a waiver of those rights.

14. Customer Agreement

By applying for, accepting or continuing to use a credit account with NSP Cases, the customer acknowledges and agrees to comply with these Credit Account Terms and Conditions and to make all payments within the agreed 30-day payment period.

These Credit Account Terms and Conditions should be read in conjunction with NSP Cases' wider Terms and Conditions of Sale and any other applicable agreement between the parties.

In the event of any conflict between these Credit Account Terms and Conditions and another written agreement, the terms of the applicable agreement shall prevail to the extent of the conflict.
